1. Who we are
These Terms of Use govern your use of the website at www.samesamecollective.org (the website).
The website is operated by the SameSame Collective, comprising:
SiyaFanaFana NPC (operating as SameSame), a nonprofit corporation registered in South Africa under registration number 2021/984428/08 and tax number 9201870269; and
SameSame Inc, a 501(c)(3) nonprofit organisation registered in the United States of America under EIN 35-2723295.
In these Terms, SameSame, we, us and our refer to both entities together, except where the context indicates otherwise.
By using the website, you agree to these Terms. If you do not agree, please do not use the website.
2. What the website is, and what it is not
The website is an information-only site. It exists so that supporters, funders, partners, journalists, researchers and members of the public can learn about who we are and what we do. The only ways you can interact with us through the website are:
by signing up for our email updates; and
by contacting us through our contact form.
We do not deliver any of our programmes or services through this website. Our youth-facing programmes are delivered through WhatsApp under separate brands, each of which has its own terms of service and privacy notice. These programme brands include:
FanaFana in South Africa;
TakaTaka in Zimbabwe;
SabiSabi in Nigeria; and
GoalDigger, HeartWork and Queerly Beloved across South Africa, Zimbabwe, Zambia, Botswana, Namibia, Lesotho and eSwatini.
If you would like to use one of those services, you will be asked to agree to its specific terms when you start using it. Nothing on this website is a substitute for those terms.
3. The website is not a crisis service
Nothing on this website, and no communication you have with us through the website, is a crisis service, an emergency service, or a substitute for professional mental health, medical or legal advice.
If you are in crisis or thinking about harming yourself or someone else, please contact your local emergency services or a crisis line in your country.
4. How you may use the website
You may use the website for your own information and for lawful purposes. When using the website, you agree that you will not:
use it in any way that breaks any applicable law;
attempt to gain unauthorised access to any part of the website, the server on which it is stored, or any connected system;
introduce viruses, malware or other harmful code;
scrape, harvest or otherwise extract data from the website by automated means without our permission;
impersonate another person, or misrepresent your relationship with any person or organisation, including in messages submitted through our contact form; or
use the website to send any content that is unlawful, defamatory, harassing or that infringes the rights of others.
5. Email updates and the contact form
When you sign up for our email updates, you are giving us permission to send you emails about our work, our impact, our fundraising and other matters we think you may be interested in. You can unsubscribe at any time by clicking the unsubscribe link in any email we send, or by emailing info@samesamecollective.org.
When you send us a message through the contact form, we will use it for the purpose for which you sent it, and we will handle your information in line with our Privacy Policy. We do our best to respond to all reasonable enquiries within a reasonable time, but we cannot guarantee a response, and we cannot guarantee a response within any particular timeframe.
6. Content and intellectual property
All content on the website — including text, images, illustrations, video, logos and brand names such as SameSame, FanaFana, TakaTaka, SabiSabi, GoalDigger, HeartWork and Queerly Beloved — is owned by, or licensed to, SameSame.
You may view, share and link to pages on the website for personal and non-commercial purposes. You may not copy, reproduce, republish or commercially use any content on the website without our prior written consent, except where the content is clearly offered under a different licence.
Press, researchers, partners and supporters who would like to use our content or logos should contact info@samesamecollective.org.
7. Third-party links
The website may include links to other websites and services that we do not operate. We do not control those websites and we are not responsible for their content, their privacy practices or anything that happens when you use them. Following a link to a third-party site is at your own risk.
8. Disclaimers
We provide the website on an "as is" and "as available" basis. We do our best to keep the information on it accurate and up to date, but we make no warranties or representations about:
the accuracy, completeness or currency of any content on the website;
whether the website will be available at any particular time, or without interruption; or
whether the website is free of errors, viruses or other harmful elements.
To the fullest extent permitted by law, SameSame is not liable for any loss or damage you suffer in connection with your use of the website, except where that loss or damage is caused by our gross negligence, fraud or wilful misconduct, or where liability cannot be excluded under applicable law.
Nothing in these Terms limits any rights you have as a consumer under laws that apply to you and that cannot be excluded by agreement, including, in South Africa, the Consumer Protection Act, 2008 and the Electronic Communications and Transactions Act, 2002.
9. Safeguarding
We work with young people, with a particular focus on LGBTQI+ young people aged 18 to 24. Our Safeguarding Policy and Code of Conduct set out the standards we hold ourselves, our staff, our contractors and our partners to. If you have a safeguarding concern about any SameSame programme, staff member, contractor or partner, please use the channels set out in that policy, including:
our independent Board Safeguarding Focal Point.
A copy of our Safeguarding Policy is available on the website.
10. Changes to these Terms
We may update these Terms from time to time. The latest version will always be available on this page, with the effective date at the top. Continued use of the website after we publish a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the Republic of South Africa, where SiyaFanaFana NPC is registered. Disputes that cannot be resolved amicably will be referred to the competent courts of South Africa.
Where you use the website from another country, local laws that protect you as a consumer or as a data subject continue to apply, in addition to these Terms.
